How safe is this?

Vaughan, Canada

So Friday night I was riding around wonderland to meet a friend. This is the road condition at that time, where I came face to face with the ground because the debris pulled my bike sideways making the turn. I'm pulling a case towards Toronto and Graham Bros. Construction to ensure roads are safe for all vehicles. As they continue construction all that road.. They continue to leave debris endangering pedestrian and bikers and motorcycle riders.

This sucks but you had fair warning that you were in a construction zone and should have adjusted your speed and technique accordingly. You're going to find that most municipalities and contractors have certain immunity to such litigation. If everything was marked as a construction zone, there is an expectation of gravel and debris.

There is no question that conditions of the road should be clean of any loose debris, and clearly that section was not.

I would be surprised if there isn't a clause in the agreement with the city and contractor, insuring that certain safety conditions are met during non-working hours.

 You were smart to photograph the area, good luck and get a lawyer. This may well be a case of the squeaky wheel getting the grease.
